Terms and Conditions of Use

These terms and conditions of use (hereinafter referred to as "T&Cs") are intended to legally frame the terms and conditions of access and use of the site and services provided by Ordalie SAS and to define the conditions of access and use of the services by the user (hereinafter the "User").

These T&Cs are accessible on the site ordalie.com under the "Terms and Conditions of Use" section.

Any registration or use of the site implies the unconditional and unrestricted acceptance of these T&Cs by the User. When registering on the site via email authentication, each User expressly accepts these T&Cs by completing the authentication process.

If the User does not accept the T&Cs stipulated in this contract, they must refrain from accessing the services offered by the site.

ordalie.com reserves the right to unilaterally modify the content of these T&Cs at any time.

The site ordalie.com is hosted by Scaleway, a Simplified Joint-Stock Company with a capital of 214,410.50 Euros, registered with the Paris Trade and Companies Register under No. 433 115 904, with its registered office at 8 rue de la Ville l’Evêque, 75008 PARIS 8, France.

Article 2: Access to the Site

2.1 The site ordalie.com provides the User access to the following services:

  • Exploration and document research based on artificial intelligence solutions; and
  • Design, drafting, and analysis of documents.

The site is accessible from any location to any User with internet access. All costs incurred by the User to access the service (computer hardware, software, internet connection, etc.) are their responsibility.

2.2. We strive, on a best-effort basis, to maintain continuous access to the site ordalie.com and commit to regularly checking its operation and accessibility. As such, it is possible that access to the site may be temporarily suspended for maintenance purposes. We do our best to inform you of these maintenance periods and minimize any inconvenience by scheduling them during low-usage hours whenever possible. We cannot be held responsible for temporary difficulties or impossibilities in accessing the site due to external circumstances, including disruptions in telecommunications networks or failures of our hosting providers. We are committed to using our best efforts to ensure the reliability and speed of data availability on our site.

Ordalie aims for a service availability of 99.95%. This is an indicative objective and does not constitute an obligation of result, meaning no liability action can be taken for failure to achieve this objective. In any case, our service availability depends on our hosting provider's service availability (Scaleway).

Article 3: Data Collection

The site ensures that the collection and processing of personal information respect privacy in accordance with Law No. 78-17 of January 6, 1978, on Information Technology, Data Files, and Civil Liberties, as amended by Law No. 2018-493 of June 20, 2018, and the General Data Protection Regulation (GDPR) of April 27, 2016.

The personal data collected in the course of Ordalie's activities are as follows:

  • The User's email address upon first connection to the site ordalie.com;
  • Information such as first name, company size, or User description, which the User may choose to enter on the site ordalie.com; and
  • Documents, files, or any other information that the User may choose to upload or share on the site ordalie.com.

The collection and processing of this data serve the following purposes:

  • Identification and authentication: To ensure secure and personalized use of Ordalie services, it is necessary to identify and authenticate users;
  • Specific offers and services: The collection of information allows for tailored and personalized access to Ordalie services, including the "PRO" offer;
  • Security: To ensure the security of the site, prevent fraud, and protect Users, it may be necessary to collect and analyze usage data to detect and address suspicious activities;
  • Use of analytics software: Analytics software is used to analyze and measure activity on the site ordalie.com, ensuring that no optional cookies are placed on Users' devices during this data collection.

The personal data collected is stored on secure servers managed by our hosting provider, Scaleway (at the Paris 2 site). We use advanced security measures to protect your data against loss, alteration, unauthorized access, or other unlawful processing—such as disk encryption, encrypted data flows, etc.

Under the Data Protection Act of January 6, 1978, the User has the right to access, rectify, delete, and object to their personal data. The User may exercise this right by emailing support@ordalie.ai

Article 4: Intellectual Property

4.1. The texts, software, logos, and content present on the site may be protected by intellectual property rights (such as copyright or trademarks) that belong to us, are licensed to us, or are lawfully used by us, except for court decisions and legal texts, which are not subject to any intellectual property rights.

4.2. We also provide hyperlinks to doctrinal commentary published on third-party websites, which may be owned by third parties. On the site, our use of these commentaries is limited to isolated words or very short excerpts where they are available.

4.3. Only access to the site and the right to use its functionalities are granted to you for the duration of your account and worldwide. Therefore, it is strictly prohibited to attempt to access the source code of the site ordalie.com, its database, or any element that may be protected by an intellectual property right, as well as to reproduce, represent, distribute, or use protected elements without our prior written authorization.

5.4. In any case, and without prejudice to any clause of the T&Cs and/or the General Terms and Conditions limiting our liability, the liability we may incur is expressly limited to direct and proven damages suffered by you as a result of our actions.

Article 9: Contract Duration

This contract is valid for an indefinite period. The beginning of the use of the site's services marks the application of the contract to the User.

Article 10: Applicable Law and Jurisdiction

These Terms and Conditions of Use are subject to the application of French law. In the event of a dispute not amicably resolved between the User and the Publisher, French courts shall have jurisdiction to settle the dispute.

Article 11: Updates

We reserve the right to modify, update, or evolve the T&Cs at any time. Any modification will be communicated by any appropriate means fifteen (15) days before the new T&Cs come into effect. Any navigation after this period will be subject to the new T&Cs.

Article 12: Effective Date

These general conditions came into effect on November 2, 2024, for new users and on November 16, 2024, for users who had an account before this date.
